Granby
Green is an Open space in Hotwells near the bottom of Granby
Hill. Part is owned by Bristol City Council, another part
by a property developer (Petherton) but the largest section
has no registered owner. A Mr Neesham (who lives in Australia)
secured a "possessory title" to the land 12 years
ago and Petherton are seeking to upgrade it to a full title.
It will enable them to submit planning application to develop
the whole site.
On May
21st 2002 security guards arrived on the site without
warning; a site hut was erected and a fence built around the
disputed section

Wood residents are preparing an application for the Community
Garden (junction of Ambrose Road and Ambra Vale EAST) to be
a Town Green. After taking legal advice it is clear that this
is the best way to preserve this patch of green permanently
for the community. It would mean local people would continue
to have the right to use the land in exactly the same way
as now.
There
is no current threat, but Town Green status would ensure that
none could arise in the future.
The
application has to show that:
•
a significant number of the inhabitants of the neighbourhood
have ‘indulged as of right in lawful sports and pastimes for
a period of at least 20 years’, and
• ‘they continue to do so at the time of the application’.
There
is clear evidence from Bristol Council documents and long-time
residents that the community has used the land for more than
20 years. What is now needed is evidence from a significant
number of people that they are (or have been) using the land,
and are aware of others doing so. It doesn’t matter how long,
provided it’s at least a year.
